BookQuest Terms of Use

1. Eligibility and Account Registration

a. Eligibility

You must be at least 13 years old to use BookQuest. By using our Service, you affirm that you meet this minimum age requirement and have the legal capacity to enter into these Terms.

b. Account Registration

To access certain features, you must create an account. You agree to provide accurate, current, and complete information and maintain its accuracy. You are solely responsible for safeguarding your account credentials, and you agree to notify us immediately of any unauthorized use or security breach.

2. Use of the Service

BookQuest provides users with features to upload book excerpts or other content, generate questions, store session data, and interact with materials to enhance reading retention. By using the Service, you agree that:

• You are responsible for any data you upload or provide, ensuring it does not infringe on intellectual property rights or violate privacy laws.
• BookQuest grants you a limited, revocable, non-exclusive, and non-transferable license to use the Service solely for your personal, non-commercial use.
• You shall not attempt to copy, distribute, modify, reverse engineer, or interfere with the Service.

3. User Content

a. User Content and Ownership

You may upload book excerpts or related content ("User Content") to use our question-generation features. You retain all ownership rights to your User Content, but you grant BookQuest a non-exclusive, worldwide, royalty-free, and transferable license to store, display, and process User Content solely for operating and improving the Service.

b. Responsibility for Content

You are responsible for the legality, reliability, and appropriateness of your User Content. We reserve the right, but are not obligated, to remove any User Content we deem harmful, infringing, or violating these Terms.

4. Intellectual Property Rights

All rights, title, and interest in and to the BookQuest Service, including its content, features, and underlying technology, are owned by BookQuest and protected under applicable intellectual property laws. You may not use any of BookQuest’s trademarks, logos, or service marks without prior written consent, except as permitted by functionality within the Service.

5. Fees and Payments

Some features of the Service may require payment. If you choose to use such features, you agree to pay all applicable fees, as disclosed to you within the Service. Fees are non-refundable unless otherwise stated, and BookQuest reserves the right to change pricing at any time with reasonable notice to you.

9. Disclaimers and Limitations of Liability

a. Disclaimer of Warranties

BookQuest provides the Service "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or free of harmful components.

b. Limitation of Liability

To the fullest extent permitted by law, BookQuest, its affiliates, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data or business, even if we have been advised of the possibility of such damages.

10. Indemnification

You agree to defend, indemnify, and hold harmless BookQuest and its affiliates from and against any claims, damages, liabilities, and expenses arising out of your use of the Service, your User Content, or your breach of these Terms.

11. Modifications to the Service and Terms
